Surplus Funds / How It Works

What Are Surplus Funds?

When a property is sold through a foreclosure or similar proceeding, the sale can sometimes generate more money than is needed to satisfy certain debts, liens, costs, and expenses. The remaining amount may be referred to as surplus or excess funds. Depending on the circumstances and applicable law, those funds may be claimable by the former property owner or another eligible party.

What Happens to the Money?

Surplus funds are generally held or administered by the court, county, trustee, or another appropriate entity until they are properly claimed or distributed.
